In a decision rendered on April 8, 2022, the Conseil d’Etat accepted the admissibility of an appeal for misuse of power against an answer published by the CNIL, in a FAQ, which the latter had itself prepared and published on its website, in line with its policy of extending the justiciability of acts and flexible law.
